Terms of Service

**PAPILLION WINDOWS & SIDING TERMS OF SERVICE**

**Effective Date: 3/31/2024**

**1. Agreement to Terms**
By accepting a quote, contracting for services, or using the services of Papillion Windows & Siding (hereafter referred to as “Company”), you agree to these Terms of Service (the “Terms”). These Terms are a legally binding contract between you and the Company, so please read them carefully.

**2. Services Offered**
The Company specializes in roofing, siding, and window installation and replacement services. All services will be performed in a professional and workmanlike manner, in accordance with industry standards.

**3. Quotes and Estimates**
All quotes and estimates provided by the Company are valid for a period of thirty (30) days from the date of issuance unless otherwise stated. Acceptance of the quote or estimate must be confirmed by the client in writing.

**4. Contract**
Upon acceptance of a quote or estimate, a contract outlining the scope of work, materials to be used, and payment terms will be provided to the client for approval and signature. No work will commence until the contract has been signed by both parties.

**5. Payment**
Payment terms will be specified in the individual contract. Unless otherwise agreed upon, a deposit is required before services are rendered. Final payment is due upon completion of the services to the satisfaction of the client, as set forth in the contract.

**6. Changes to Service Scope**
Any changes to the scope of work after the acceptance of the initial quote and signing of the contract may result in adjustments to pricing and timelines. Such changes must be agreed upon in writing by both parties.

**7. Cancellations**
The client may cancel a contract, in accordance with cancellation terms specified within the contract. Cancellation may be subject to cancellation fees as detailed in the contract.

**8. Warranty**
The Company provides a warranty for certain services as specified in the contract. Warranty periods and conditions will vary based on the nature of services rendered and materials used. Warranty information will be provided in writing.

**9. Limitation of Liability**
In no event will the Company be liable for any indirect, special, incidental, consequential, or punitive damages of any kind. The Company’s total liability to you for all losses, damages, and causes of action will not exceed the amount you paid for the service.

**10. Permits and Compliance**
The client is responsible for securing any necessary permits. The Company will comply with all applicable local, state, and federal regulations in the performance of its services.

**11. Dispute Resolution**
In the event of a dispute, both parties agree to work in good faith to resolve the matter amicably before resorting to arbitration or legal proceedings.

**13. Modification of Terms**
The Company reserves the right to modify these terms at any time. Your continued use of the Company’s services after any modification indicates your acceptance of the new terms.

**14. Governing Law**
These Terms shall be governed by and construed in accordance with the laws of the state in which the Company operates, without giving effect to its conflict of laws provisions.
